Who we are
102147155 Saskatchewan Ltd. operating as Upperack (“Upperack,” “we,” “us,” or “our”) provides custom apparel and engraved goods to teams and organizations across Canada. This Privacy Policy explains how we collect, use, share, and protect personal information when you use upperack.ca or engage our services.
We comply with the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, provincial privacy legislation including Quebec’s Act respecting the protection of personal information in the private sector (Law 25), British Columbia’s Personal Information Protection Act, and Alberta’s Personal Information Protection Act.
What we collect
Information you give us — your name, email address, phone number, billing and shipping addresses, project briefs and files, photographs and artwork you upload, business or organization name, and order history.
Information collected automatically — your IP address, device and browser type, the pages you visit on our site, the time and length of your visit, and the site that referred you. This is collected through cookies and similar technologies.
Information we do not collect — we do not store full payment card details. Payments are processed by Stripe, which handles card data directly under its own security and privacy standards.
How we use your information
- To prepare quotes, review your files, and produce and ship your order
- To communicate about your project, including questions, approvals, and updates
- To improve our site, services, and customer experience
- To comply with our legal, tax, and accounting obligations
- With your consent, to send occasional updates about new products or services
Consent
By submitting a project request, placing an order, or contacting us, you consent to the collection and use of your personal information for the purposes described in this policy. You may withdraw consent at any time by emailing us at services@upperack.ca, subject to legal or contractual requirements. For example, we cannot delete information required to complete an active order or to meet our tax obligations.
Who we share your information with
We do not sell personal information.
We share personal information only with parties necessary to provide our services to you, including:
- Shipping providers (Canada Post, Purolator, or similar carriers)
- Payment processors (Stripe)
- Hosting, email, and form services (WordPress, Formidable Forms, our hosting provider)
- Analytics providers (Google Analytics, where enabled)
- Authorities, when required by law or to protect our rights or safety
- A successor entity in the event of a merger, acquisition, or sale of business assets
Some service providers process or store data outside Canada, typically in the United States. When data crosses borders, it becomes subject to the laws of the country where it is stored. We take reasonable steps to ensure providers maintain appropriate safeguards.
How we protect your information
We use industry-standard safeguards, including HTTPS encryption in transit, restricted access controls, and secure handling of project artwork. No method of transmission or storage is fully secure, and we cannot guarantee absolute security of your information.
How long we keep your information
- Order and invoice records — seven (7) years, as required by the Canada Revenue Agency
- Project files and artwork — two (2) years after the last activity on your account, then deleted unless you ask us to retain them for reorders
- Marketing contacts — until you unsubscribe
- Site analytics data — typically 14 months, per Google Analytics defaults
Your rights
Under PIPEDA and applicable provincial laws, you have the right to:
- Access the personal information we hold about you
- Request correction of inaccurate or incomplete information
- Withdraw consent for ongoing uses, subject to legal or contractual requirements
- Request deletion, subject to the retention requirements described above
- Lodge a complaint with the Office of the Privacy Commissioner of Canada
If you live in Quebec, you also have rights under Law 25 to data portability and to information about decisions made about you solely by automated means.

Children
Our services are not directed to individuals under 18 years of age. We do not knowingly collect personal information from minors. If you believe a minor has provided us with information, please contact us so we can delete it.

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated “Last updated” date. Material changes will be communicated by email where reasonably possible. Continued use of our site or services after a change means you accept the updated policy.
